Jay Clayton, nominated for Director of National Intelligence, repeatedly refused to state who won the 2020 presidential election, despite senators pressing him on his obligation to be honest and forthright. He acknowledged Joe Biden was certified and had the most electoral votes, but declined to say Biden won. Clayton also said he was unaware until the hearing that Director Gabbard was present at the Fulton County raid, that she testified her presence was requested by the president, or that the committee was probing her conduct. He admitted the general counsel and deputy general counsel of his office had testified on the matter. When asked if he would oversee a domestic search warrant on an election facility if asked by the president, he called it hypothetical. Senators criticized his evasiveness, arguing he must be able to disagree with the president.
